1. Privacy Policy

Information we collect

When you create a business account we collect: company name and contact details, authorized user names and emails, business address, EIN, resale/exemption certificates, order and payment information, and any 3D design files (STL) or specifications you upload.

How we use it

• To verify your business, open your account and process tax-exempt sales where applicable.
• To quote, manufacture, ship and invoice your orders, and to provide production tracking.
• To communicate about orders, service updates and — only if you opt in — commercial offers.
• To comply with legal obligations (tax, accounting, anti-money-laundering rules applicable to precious metals).

Sharing

We never sell your data. We share it only with service providers strictly needed to operate: payment processing, shipping carriers (e.g. FedEx), cloud hosting and communications infrastructure — each bound by confidentiality. Your design files are shared internally only with production staff assigned to your order.

Security & retention

Data is transmitted encrypted (TLS) and stored with access controls. We keep account and transaction records for as long as your account is active and as required by tax and commercial law; you may request deletion of data we are not legally required to keep at design@atelier01.com.

Your rights

You may request access, correction, a copy, or deletion of your personal information, and may opt out of marketing at any time. Contact design@atelier01.com.

Cookies

The platform uses only cookies necessary for sign-in sessions and language preference. We do not run third-party advertising trackers.

2. Terms of Service

These Terms are an agreement between your company (“Client”) and Atelier01 Jewelry Inc. (“Atelier01”, “we”). By creating an account or placing an order you accept them.

• Business accounts only. The platform serves companies and professional designers. You confirm the information provided (including EIN) is accurate and that you are authorized to act for the Client.
• Account security. You are responsible for activity under your credentials and for managing your team's access.
• Acceptable use. No unlawful use, no attempt to breach security, no reproduction of the platform.

3. Design Files & Intellectual Property

• Your designs stay yours. You retain full ownership of STL files and designs you upload. You grant Atelier01 a limited license to use them solely to quote and manufacture your orders. We do not resell, publish or reuse your files for other clients.
• Your warranty to us. You represent that you own or are licensed to use every design you upload and that manufacturing it does not infringe third-party rights. You will indemnify Atelier01 against claims arising from designs you supply.
• Atelier01 library. Models from our library remain Atelier01 property; purchasing a manufactured piece does not transfer design ownership or exclusivity unless agreed in writing.

4. Pricing & Gold Price Lock

• Quotes state their validity period. After expiry, metal pricing is re-based on the current market reference.
• Where a gold price lock is offered, the locked rate, reference spot price, coverage window and any lock fee are stated on the quote. The lock applies only to the quoted items and quantities.
• Labor, stones, finishing and shipping are itemized separately on the quote.

5. Orders, Production & Shipping

• Production begins after order confirmation and, where applicable, payment or deposit per the quote.
• Lead times are expressed in business days per production stage and are good-faith estimates; they may adjust for design revisions, stone availability or force majeure. You can follow every stage on your tracking page.
• Standard jewelry manufacturing tolerances apply (weight, dimensions, stone sizes within trade norms).
• Shipments are sent insured via carrier options shown at checkout. Risk of loss transfers on delivery; title transfers on full payment.
• Inspect shipments on arrival and report discrepancies within 5 business days.

6. Tax Exemption

Tax-exempt treatment depends on a valid, current resale or exemption certificate for the ship-to jurisdiction. You are responsible for the accuracy and renewal of certificates you upload and for any tax, penalty or interest resulting from an invalid certificate.

7. Warranty & Returns

• Every piece passes quality control before shipping. We warrant against manufacturing defects; defective items will be repaired or remade at our cost.
• Because production is custom, orders cannot be cancelled or returned once casting has begun, except for defects or non-conformity with the approved specification.
• Normal wear, damage from misuse, and modifications by third parties are not covered.

8. Liability & Governing Law

To the maximum extent permitted by law, Atelier01's aggregate liability for any order is limited to the amount paid for that order, and neither party is liable for indirect or consequential damages. Nothing limits liability that cannot be limited by law.

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA. Any dispute will be resolved in the state or federal courts located in Massachusetts, after a good-faith attempt at amicable resolution.
